Intel, Samsung get behind new Linux phone software (Reuters)

(Reuters) ? Two Linux software groups have joined forces, they said on Wednesday, to develop a new operating system for cellphones and other devices in collaboration with Intel and Samsung Electronics.

However, analysts said the new Tizen platform is likely to struggle to attract wider developer and manufacturer support to compete with the dozen or so other mobile operating systems in a market dominated by Apple and Google's Linux-based Android.

Even industry majors Nokia and Hewlett-Packard have ditched their mobile platforms this year.

"The best hope for them is that big operators get worried by Android's increasing smartphone dominance and decide to consciously switch their allegiances to rival platforms to restrict Google's huge influence over the mobile market," said analyst Neil Mawston from Strategy Analytics.

LiMo Foundation and the Linux Foundation said the new Tizen platform is an open-source, standards-based software platform that supports multiple devices including smartphones, tablets, smart TVs, netbooks and in-vehicle 'infotainment' systems.

The initial release is planned for the first quarter of 2012, enabling the first devices using Tizen to come to market in mid-2012, the two groups said.

The world's largest semiconductor firm Intel, which also has its own MeeGo Linux system, and Samsung Electronics, the second biggest maker of cell phones and one of the key contributors to LiMo, will head the technical steering committee developing Tizen.

"Tizen aims to unify a number of marginalized Linux based platforms," said Geoff Blaber, an analyst at London-based telecoms industry consultancy CCS Insight.

"There is a willingness to create an independent alternative to Android but history tells us that willingness doesn't necessarily equate to success," he added.

Samsung is the leading user of the Android platform, but some other makers of Android-operated phones have begun to look at alternatives since Google agreed to buy Motorola Mobility last month for $12.5 billion.

"Samsung might be further tempted to try a new system as Google's acquisition of Motorola Mobility raised uncertainty over the future of Android," said Song Jong-ho, an analyst at Daewoo Securities.

A spokesman for Samsung said: "We've been a core Linux partner ... and this is in line with our strategy of supporting many platforms."

Earlier this month Intel and Google launched a development partnership to adapt Android for Intel's Atom processor chips, with a view to having the first Android phones featuring Intel chips in the first half of next year.

Linux is the most popular type of free, or open-source, computer operating system which allows the public to use, revise and share. Linux suppliers earn money selling improvements and technical services.

Children placed with parents of missing Utah mom (AP)

TACOMA, Wash. ? The children of a Utah woman who's been missing since late 2009 have been placed in the care of her parents.

Sherry Hill, a spokeswoman for the Washington state Children's Administration, said Tuesday that the department's legal counsel had confirmed in court that the 4- and 6-year-old sons of Susan and Josh Powell would remain with Susan's parents, Chuck and Judy Cox, pending future court orders.

The boys had been living with Josh Powell and his father, Steve, in Puyallup, but the children were taken out of the home last week after Steve was arrested on charges of voyeurism and possessing child pornography. John Long, the assistant attorney general representing the Children's Administration, told a judge Tuesday that Josh Powell is also a subject in that investigation ? prompting Josh to quickly deny any such activity.

"I have had nothing to do with any kind of illegal pornography," he said.

Chuck Cox's attorney, Steve Downing, confirmed that the boys were turned over to his clients Tuesday afternoon.

"The Cox family has had a very good and very strong relationship with these children," Downing said. "They had a joyous reunion and that's all I can say."

Pierce County sheriff's spokesman Ed Troyer did not immediately return an email seeking to confirm Long's assertion, but told The News Tribune of Tacoma that everyone in Steve Powell's house is a person of interest: "We have not eliminated anybody and we are not at the point of arresting anybody else," Troyer said.

The boys were placed in foster care after Steve Powell's arrest, but by Tuesday Child Protective Services had turned them over to their maternal grandparents.

Downing told the judge that the children were being harmed because they had never received counseling about their mother's disappearance, they might have been exposed to the inappropriate videos, and they had been cut off from their maternal grandparents without explanation.

"Those kids may know something, and he sure as the dickens doesn't want them talking to anybody," Downing told Judge Kathryn Nelson.

Powell countered that he's a good, loving father; that the children are not at risk; and that they've never been exposed to porn of any kind. He also made clear that his family would not be posting bail for his father, and that if Steve Powell somehow managed to return home, Josh Powell would take the boys and stay at a hotel.

"There is no clear and present danger to my sons," he said.

Steve Powell pleaded not guilty to 14 charges of voyeurism and one of possession of child pornography. He remains jailed on $200,000 bail. Prosecutors said that for at least a decade, he had been secretly filming women, including Susan Powell, and that he shot footage of two young neighbor girls as they took baths and sat on the toilet.

The judge took the matter under consideration and told the parties to reconvene Wednesday morning. After the hearing, Chuck Cox declined to comment when asked about whether his grandsons were already staying with him.

Josh Powell frequently came near tears during Tuesday's hearing, breaking up as he described how the boys sat on his lap and hugged him during a visit supervised by CPS on Monday. He also grew emotional as he described the failure of the "general public" to look for his wife: "That, your honor, is deeply hurtful to me."

Josh Powell has said he took his boys, then 2 and 4, on a late night camping trip in freezing temperatures the day his wife disappeared from their West Valley City, Utah, home.

Authorities wrapped up a 12-day search of the desert Friday about 30 miles from where Josh Powell said he went camping that night. At one point, they said they found a "shallow grave" after cadaver dogs alerted them to the spot. But they found no human remains. Charred wood chips discovered in the hole have been sent to a lab for testing.

Bachmann: GOP nominee must be true conservative

(AP) ? Eclipsed by Rick Perry, Republican presidential candidate Michele Bachmann dismissed concerns on Monday about the strength of her campaign and told supporters that she alone has the best conservative credentials to be president.

"I've got the complete skill set to do this job," she told roughly 35 people in a half-full hotel ballroom on a rainy day.

Bachmann repeatedly urged people not to settle on a moderate candidate who is seen as better able to cobble together the diverse coalition of voters needed to beat President Barack Obama.

"This message has to be driven home by conservatives: We can't settle. We can't settle. We have to have a candidate who has it all," she said. "Who is a fiscal conservative, and I am. Who is a national security ? peace through strength conservative ? like Ronald Reagan was. And I am. And we have to have someone who is a social conservative, who believes in the family. And I do. And we need a tea party conservative, and I am."

While she didn't name any of her rivals, she suggested some of them could not be trusted to repeal Obama's health care law. She also suggested they did not understand foreign policy as well as she does and that they were compromised because they had done favors for political donors, comments apparently directed at Perry, the Texas governor competing with her for voters in Iowa's first-in-the-nation caucuses next year.

The three-term Minnesota congresswoman has struggled since winning the Iowa straw poll in August ? the same day that Perry got into the race and took away some of her support among conservatives. She once sat atop national public opinion polls but now only registers single-digit support.

Bachmann thanked the people who showed up and seemed to try to justify the relatively light attendance.

"I know it was short notice," she said, "it's in the middle of the day, everyone's at work, it's a rainy day, there's a lot of places you can be." She shook nearly every hand in the room and signed autographs.

She dismissed suggestions that her campaign was floundering, saying voters would pick the nominee, not the news media. And she said she believes she is "positioned perfectly right now" to compete for the nomination because conservatives are looking for someone with her fiery message and record of opposing Obama.

Among those in attendance was Leon Hartogh of Marion, a 74-year-old retired golf course superintendent and self-described tea party conservative. He said he was not entirely happy with the GOP field and wanted New Jersey Gov. Chris Christie, who professes no plans to run for president in 2012, to enter the campaign. He said he likes Bachmann the best "in the field that's out there now" and that any of the Republicans could defeat Obama.

"I like her stand on everything. She just talks the talk," he said.

Stifel Nicolaus Analysts Now Covering Asbury Automotive (ABG ...

FACT CHECK: Slippery assertions in GOP debate (AP)

WASHINGTON ? Texas Gov. Rick Perry declared in the Republican presidential debate Thursday night that he had never advocated turning Social Security over to the states. His denial was hard to fathom given his past rhetoric about the program.

"Let the states do it," he said last year, for example.

In the latest debate, Michele Bachmann misread presidential approval polls and denied making a statement that she actually did make just the week before, concerning a vaccine for girls. Mitt Romney denied supporting an Obama administration education program that he had praised.

But the most consequential exchange may have been over Social Security, and Perry's changing thoughts about it.

A careful parsing of Perry's words over the past months shows that his position on Social Security is not cut and dried. As he said in the debate, he believes that states should be allowed to exempt certain state or local government employees from the program, in favor of a state-approved alternative. That's already the reality in some places, including at least three Texas counties.

Far more radical is the idea of essentially dismantling Social Security as a federal entitlement and making states responsible for basic retirement security of all its citizens. He asserted in the debate, "We never said that we were going to move this back to the states."

But at times, Perry has sounded very much in favor of doing just that. In a November appearance on MSNBC, he said of Social Security, "Get it back to the states. Why is the federal government even in the pension program or the health care delivery program? Let the states do it."

What's clear is that Perry, in his book and afterward, trashed Social Security as a "Ponzi scheme" and "crumbling monument to the failure of the new deal" and has since backtracked on such harsh words, especially since rival Romney has come to the defense of the popular entitlement.

A look at some other statements in the Florida debate and how they compare with the facts.

BACHMANN: "President Obama has the lowest public approval ratings of any president in modern time."

THE FACTS: That's true, if you leave out Harry Truman, Richard Nixon, George W. Bush, Jimmy Carter, George H.W. Bush, Lyndon Johnson, Ronald Reagan, Bill Clinton and Gerald Ford. All of them at some point in their terms dipped lower than Obama's low point of 38 percent job approval, according to Gallup's comparison.

ROMNEY: "I don't support any particular program that he's describing," he said, disputing Perry's claim that Romney favors some of President Barack Obama's education initiatives, specifically the Race to the Top program.

THE FACTS: Romney was reluctant to tell Republican primary voters he doesn't hate every Obama policy. Romney does indeed support some of the specific policy changes encouraged by the Race to the Top program and said as much earlier in the week. Speaking in Miami on Wednesday, he praised the president's education secretary, Arne Duncan, for the program. And during the debate, Romney acknowledged supporting elements of the initiative, including teacher evaluations and charter schools.

ROMNEY: "I believe government is too big. It's gone from 27 percent of our economy in the years of JFK to 37 percent of our economy."

THE FACTS: Romney is including state and local government spending along with federal spending. His numbers are not far off, but most of the big increases came from Social Security and Medicare payments. Medicare started after Kennedy's presidency. Now it is one of the biggest government spending programs, and one of the most popular. Federal spending alone accounted for 23.8 percent of the gross domestic product last year and is expected to reach 25.3 percent this year.

PERRY: It's not the first time that Mitt has been wrong on some issues before. And the bottom line is, we never said that we were going to move this (Social Security) back to the states."

ROMNEY: "Well, it's different than what the governor put in his book just, what, six months (ago), and what you said in your interviews following the book. So I don't know. There's a Rick Perry out there (who) ... says that the federal government shouldn't be in the pension business, that it's unconstitutional. Unconstitutional and it should be returned to the states."

THE FACTS: In his book Perry heavily criticized Social Security, advocated states' rights and suggested federal entitlements were unconstitutional in general, but he never tied these beliefs together as succinctly as Romney claimed.

Even so, he danced close to branding Social Security as unconstitutional. He called Social Security the best example of a program that tosses "aside any respect for our founding principles of federalism." He also lamented: "If only the New Dealers had been kind enough to allow workers to make their own choice about whether to participate." And he said the program was introduced "at the expense of respect for the Constitution and limited government."

ROMNEY: Obama "addressed the United Nations in his inaugural address and chastised our friend, Israel, for building settlements, and said nothing about Hamas launching thousands of rockets into Israel."

THE FACTS: Obama in his 2009 address to the U.N. General Assembly by no means ignored the plight of Israelis.

Describing those who pay the "greatest price" for the conflict, Obama spoke of an Israeli girl in the town of Sderot "who closes her eyes in fear that a rocket will take her life in the middle of the night." Sderot borders the Gaza Strip and has been the target of hundreds of rockets fired into Israel from Hamas-controlled Gaza.

In the 2009 speech, Obama also did reject the "legitimacy" of Israeli settlement construction in lands the Palestinians want for their state, but those terms are largely reflective of American thinking over the last three-and-a-half decades. The Obama administration later vetoed a U.N. resolution that would have condemned Israel for the policy.

Obama, Europeans press Palestinians to drop UN bid (AP)

UNITED NATIONS ? Furiously scrambling to head off a U.N. showdown, the United States warned world leaders Wednesday that trying to create a Palestinian nation by simple decree instead of through hard negotiations was bound to fail as a shortcut to peace with Israel. Europeans worked to defuse the dispute, too, France urging new talks within a month.

Undeterred, Palestinian President Mahmoud Abbas pressed toward a formal bid for U.N. recognition that could bring the issue to a head on Friday.

Addressing the U.N., President Barack Obama and French President Nicolas Sarkozy offered different solutions to defuse the diplomatic crisis. Sarkozy would have the Palestinians seek a lesser form of recognition at the U.N., while joining new talks with Israel.

The Israeli-Palestinian conflict, seen as a defining test of peace in modern times, overwhelmed other matters as members of the world body watched a crisis deepen before them.

A frustrated Obama declared to U.N. members that "there are no shortcuts" to peace, and he implored Israelis and Palestinians to restart direct talks. His influence limited and his hopes for a peace deal long stymied, Obama didn't directly call on the Palestinians to drop their bid for recognition from the U.N. Security Council. But the U.S. threat to veto any such U.N. action loomed unmistakably.

"Peace will not come through statements and resolutions at the United Nations," Obama told delegates. "If it were that easy, it would have been accomplished by now."

Sarkozy supported an observer state status for Palestine but not full U.N. membership for now. That idea would head off a Security Council vote and veto that he said would risk "engendering a cycle of violence in the Middle East."

The French president proposed a one-year timetable for Israel and the Palestinians to reach an accord.

The White House said the U.S. agreed with the broad goals of the French proposal, but disagreed with Sarkozy on the value of a U.N. status upgrade for the Palestinians ahead of a peace accord.

Palestinian officials made it clear that the latest proposal, while welcome, would do nothing to prevent them from going to the Security Council and seeking full statehood.

"This is a moment of truth," said Nabeel Shaath, an Abbas adviser.

Palestinian senior aide Saeb Erekat said the pursuit of full U.N. membership would not be slowed: "We will not allow any political maneuvering on this issue," he said.

At the heart of the fight, Abbas and Israeli Prime Minister Benjamin Netanyahu pursued support from other leaders but not each other. Various mediators searched for consensus for a diplomatic solution to preclude the showdown and revive peace talks.

Netanyahu thanked Obama for defending Israel, which fears that a Palestinian state drawn by the U.N. would include borders leaving the Jewish state vulnerable to attack. The United States is Israel's staunchest defender in demanding that direct talks are the only means to Palestinian statehood, a position that leaves Obama arguing against fast world endorsement of a Palestinian homeland he has repeatedly said he supports.

Obama and Abbas met for more than 45 minutes Wednesday evening. The White House wouldn't say whether Obama directly asked the Palestinian leader to abandon his plans to pursue full U.N. membership, saying only that he reiterated his opposition to the statehood bid and the U.S. intention to issue a veto.

Beyond the public eye, U.S. and other officials began to concede that an effort to deter Palestinians from bringing the matter before the world body had failed, and the so-called Quartet of Mideast peace mediators worked on a deal intended to address the longstanding concerns of both sides.

Under that compromise plan, the Quartet would issue a statement in which Israel would have to accept its pre-1967 Mideast War borders, with land exchanges, as the basis for a two-state solution, and the Palestinians would have to recognize Israel's Jewish character if there was to be a deal, officials close to the talks said.

The officials spoke on condition of anonymity to discuss ongoing diplomacy.

A spokesman for Abbas, however, said the Palestinian leader told Obama Wednesday that the Quartet statement would not meet his basic requirements to return to peace talks, in part because the Palestinians oppose recognizing the Jewish character of Israel.

European officials, supported by the U.S., were still continuing to outline the compromise agreement to the Israeli and Palestinian governments and asking for tough concessions from each.

The Palestinians would petition the United Nations Security Council on Friday, as expected, but would agree not to press for action on the request for statehood recognition for a year, or would withdraw it later. That would allow Abbas to save face and prevent an embarrassing defeat that might empower his Fatah party's rival faction, the militant Islamic group Hamas, which is considered a terrorist group by Israel and the United States.

In the 15-member Security Council, approval of a resolution requires nine "yes" votes and no veto by a permanent member ? the U.S., Russia, China, Britain and France. If the resolution gets fewer than nine votes, it would be defeated without the U.S. having to use its veto.

While the Palestinians' full membership bid would meet with a certain U.S. veto in the Security Council, assuming there were enough votes to have it approved, they still would have succeeded in bringing the issue back to the forefront of the world's political discussions after years of failed negotiations, bickering and sporadic outbreaks of violence.

Short of a full request for statehood recognition at the U.N. Security Council, the Palestinians could also seek a lesser form of recognition by the larger U.N. General Assembly, where they have overwhelming support.

Sarkozy called for Israelis and Palestinians to return to talks in one month with no preconditions ? requiring an enormous leap of faith from both sides ? with six months to work out the issues of borders and security that have divided them for decades. He called for a peace accord within a year.

A senior European Union official said the proposal laid out by Sarkozy matched one by EU foreign policy chief Catherine Ashton during a meeting with EU foreign ministers on Tuesday. The official spoke on condition of anonymity because of the sensitivity of the discussions.

The proposal outlined by Sarkozy received a warmer welcome from the Palestinians than Obama's comments, which elicited stern looks from the Palestinian delegation.

"Ultimately, it is the Israelis and the Palestinians ? not us ? who must reach agreement on the issues that divide them," Obama said.

Were the Palestinians to accept the French approach, they would become a nonmember observer state at the U.N. That would give them an opportunity to seek membership in U.N. agencies and to join treaties, including possible access to the International Criminal Court. There, Palestinians could press legal claims against Israel for alleged abuses as an occupier.

Obama blitzed through a day of diplomacy that was appropriately bracketed by individual meetings with Netanyahu and Abbas. But for all his effort, Obama appeared to end a day of flurried diplomatic activity right where he started it.

Two years after declaring a new brand of U.S. leadership, and one year after calling for Israel and Palestinian leaders to reach a peace deal by now, Obama found himself standing before the U.N. delegates and admonishing them about what their goal should be ? encouraging the parties to sit down together.

"That is the project to which America is committed," he said. "There are no shortcuts. And that is what the United Nations should be focused on in the weeks and months to come."

Netanyahu, with Obama at his side, told reporters that world leaders were under "enormous pressure" but should follow the lead set by the United States. To Obama, with whom he has not shared much public chemistry, Netanyahu said the president had stood on principle in his speech and thanked him for wearing what he called a badge of honor.

Senior Palestinian officials said Abbas would seek to cooperate with the U.S. and would be ready to return to the negotiating table once a solid foundation for talks was in place.

Using the current economic expansion moving ahead in 2005, the key issue for real estate is: will the normal relationships between overall business activities, interest in space, increasing demands for money, and rising levels of property development prevail as in past cycles

Or will be unusual curt flood of capital into real property markets cause different cyclical outcomes

In the normal business cycle, because the economy moves out of recession into expansion, growing levels of business activity raise demand for both money and commercial space. These increases put upward pressure on rates of interest and occupancy levels in commercial space. Rising rates of interest, plus current high vacancy rates minimizing rental rates, continue to inhibit new commercial property construction. Also, investors are drawn from real estate investments into competing asset forms for example stocks of successful companies.

These conditions produce only gradual absorption. Vacancies are falling and rates are stable or rising, but neither holding far enough to justify a brand new development, especially since interest rates rise as well as other competing investments.

With the accelerating general expansion, increased competition for existing space drives vacancies lower and rates higher. Eventually, these changes stimulate developers to start a new construction projects, in spite of higher interest rates. This starts the expansion phase of the cycle. New projects start just as the overall business cycle peaks. Then with the growth of available space, combined with a fiscal slowdown, the result is another overbuilt phase just as the economy slips back into a recession.

Presently most commercial finance industry is in the gradual absorption phase, rich in amounts of vacancies declining and rents stabilizing. Downtown office vacancy rates have dropped slightly while national industrial vacancy rates remain unchanged. However, bold office and industrial vacancies are more than double the lower rates they?d at the end of 2000.

Consequently, new office construction dropped off. New industrial development also fell on. However, the demand to purchase well-occupied properties of all types remain high due to the flood of cash starting real property investment.

Most experts predict this case cannot last. Some claim rapidly rising interest rates can make a real estate less attractive to invest in and cause some values to fall. Others think with so much cash still trying to invest in real estate that rising rates of interest will not dampen investor enthusiasm.

Still others believe that the demand for property will not fall off unless the stock exchange makes dramatic increases. Enough uncertainty remains about world economic conditions to inhibit investor enthusiasm to get back to stocks. In addition, underlying market conditions are slowly improving, supporting positive investor attitudes toward property.

The flood of money has not stimulated an enormous move into new property development which previously would have happened if funds were available so easily. Also, the ability of real estate to pay cash incomes which are higher than most stocks or bonds make property increasingly appealing to pension funds that are facing rising payouts and retiring baby boomers in need of good incomes.

Therefore, there may not be a not too distant future call apps of real property values except in some condominium housing markets were speculative purchasing could lead to sudden shrinkage of occupancy. Todays huge investor appetite for properties get this to a perfect time to sell property. But these conditions will not last forever.

Interest rates will certainly increase in the near future with the Federal Reserves need to raise rates coupled with a growing expansion in the financial system. If current favorable borrowing conditions continue, more developers is going to be tempted to start building new projects that lead to a different boom. That would undermine improving market conditions, because it has previously, and may dampen investor interest in properties.

The moral: once the sun is shining, you better make hay.
